Terms governing the use of our services and website

1. Introduction
These Terms and Conditions ("Terms") govern your use of the Mondo Edile Ltd website and the provision of our services. By accessing our website or engaging our services, you agree to be bound by these Terms.

2. Definitions
- "Company", "We", "Us", "Our": Refers to Mondo Edile Ltd
- "Client", "You", "Your": Refers to the person or entity engaging our services
- "Services": Includes piling, screw piling, groundworks, and all related construction services provided by Mondo Edile
- "Website": Refers to mondoedile.co.uk
- "Contract": The agreement between Mondo Edile and the Client for the provision of Services
3. Service Agreement
3.1 Quotations
All quotations provided are valid for 30 days unless otherwise stated. Quotations are based on the information provided by the Client and are subject to site assessment. We reserve the right to adjust quotations if site conditions differ from those initially described.
3.2 Contract Formation
A contract is formed when:
- You accept our written quotation in writing
- We receive any required deposit or advance payment as specified in the quotation
- We issue written confirmation of acceptance of your order
3.3 Site Access
The Client must ensure that our team has safe and adequate access to the site, including provision for parking of vehicles and storage of materials and equipment. Any delays or additional costs arising from inadequate access will be the Client's responsibility.
4. Payment Terms
4.1 Payment Schedule
Unless otherwise agreed in writing, payment terms are as follows:
- Deposit: 30% upon acceptance of quotation
- Progress payments: As specified in the contract or upon reaching agreed milestones
- Final payment: Upon completion of works
4.2 Payment Methods
We accept payment by bank transfer, cheque, or other methods as agreed. All invoices must be paid within 14 days of invoice date unless otherwise specified.
4.3 Late Payment
Late payments may incur interest charges at the rate of 8% above the Bank of England base rate per annum, as permitted under the Late Payment of Commercial Debts (Interest) Act 1998. We reserve the right to suspend work if payments are not received on time.
4.4 VAT
All prices quoted are exclusive of VAT unless stated otherwise. VAT will be charged at the prevailing rate and shown separately on invoices.
5. Our Obligations
Mondo Edile Ltd undertakes to:
- Provide services with reasonable skill and care in accordance with industry standards
- Comply with all relevant UK building regulations and health & safety legislation
- Use appropriately qualified and experienced personnel for all works
- Maintain adequate insurance coverage for our operations
- Complete works within agreed timescales, subject to circumstances beyond our reasonable control
- Provide all necessary materials and equipment unless otherwise agreed
6. Client Obligations
The Client agrees to:
- Provide accurate information about the site and project requirements
- Obtain and provide copies of all necessary planning permissions, building regulations approvals, and other consents
- Ensure the site is safe and clear of hazardous materials (asbestos, contamination, etc.)
- Arrange for utility companies to identify and mark the location of underground services
- Provide adequate site access, parking, and storage facilities
- Make payments in accordance with agreed terms
- Notify us immediately of any concerns or issues with the works
7. Variations and Additional Works
Any variations to the agreed scope of works must be requested in writing. We will provide a written quotation for additional works, which will be charged separately. Variations may affect project timescales.
If we encounter unforeseen ground conditions or other site issues that require additional works, we will notify you immediately and provide details of any cost and time implications before proceeding.
8. Project Delays and Extensions of Time
We will make reasonable efforts to complete works within agreed timescales. However, we cannot be held liable for delays caused by:
- Adverse weather conditions
- Unforeseen ground conditions
- Discovery of underground services or obstructions
- Late delivery of materials or equipment by suppliers
- Delays by other contractors on site
- Client-requested variations or changes
- Force majeure events (see Section 14)
9. Health and Safety
Mondo Edile is committed to maintaining high health and safety standards in accordance with the Health and Safety at Work Act 1974 and Construction (Design and Management) Regulations 2015.
The Client must ensure that the site complies with all relevant health and safety regulations and inform us of any known hazards. We reserve the right to stop work if we identify serious safety concerns.
10. Quality and Workmanship
10.1 Standards
All works will be carried out in accordance with:
- Relevant British Standards and Eurocodes
- UK Building Regulations
- NHBC Standards (where applicable)
- Engineers' specifications and drawings
10.2 Warranty
We warrant that our work will be free from defects in workmanship for a period of 12 months from the date of practical completion, subject to:
- Normal wear and tear
- Proper maintenance by the Client
- No unauthorized modifications
- Works by other parties that may affect our work performance
10.3 Defects
Any defects must be reported to us in writing within 7 days of discovery. We will inspect the defect and, if it is our responsibility, rectify it at no additional cost within a reasonable timeframe.
11. Liability and Insurance
11.1 Our Liability
Our total liability under any contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total value of the contract.
11.2 Excluded Liability
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded by English law
11.3 Insurance
We maintain adequate professional indemnity insurance and public liability insurance. Details of our insurance coverage are available upon request.
12. Intellectual Property
All designs, drawings, specifications, and documentation prepared by us remain our property unless specifically agreed otherwise in writing. You may use these materials solely for the purpose of the contracted project.
13. Termination
13.1 Termination by Client
You may terminate the contract by giving us 14 days' written notice. In such cases, you will be liable for:
- Payment for all works completed to date
- Costs incurred for materials ordered
- Reasonable costs for demobilization
- Loss of profit on unexecuted work (typically 10-15%)
13.2 Termination by Mondo Edile
We may terminate the contract immediately if:
- You fail to make payment when due
- You breach any material term of the contract
- Site conditions make it unsafe or impossible to continue work
- You become insolvent or enter bankruptcy proceedings
14. Force Majeure
Neither party shall be liable for failure to perform obligations due to circumstances beyond their reasonable control, including but not limited to: acts of God, war, terrorism, pandemic, government restrictions, strikes, or natural disasters.
15. Data Protection
We will process your personal data in accordance with our Privacy Policy and applicable data protection legislation. Please refer to our Privacy Policy for full details on how we handle your information.
16. Dispute Resolution
In the event of any dispute arising from these Terms or the provision of our services, the parties agree to attempt to resolve the matter through good faith negotiation.
If negotiation fails, either party may refer the dispute to mediation before resorting to litigation. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. Website Use
17.1 Acceptable Use
When using our website, you agree not to:
- Use the website in any way that breaches applicable laws or regulations
- Transmit any material that is defamatory, offensive, or obscene
- Attempt to gain unauthorized access to our systems or networks
- Interfere with the proper functioning of the website
17.2 Content Accuracy
While we make every effort to ensure information on our website is accurate and up-to-date, we make no warranties or representations as to its accuracy. Project images and case studies are provided for illustrative purposes.
18. General Provisions
18.1 Entire Agreement
These Terms, together with any written quotation and contract, constitute the entire agreement between the parties and supersede all previous agreements or representations.
18.2 Amendments
We may update these Terms from time to time. Changes will be posted on our website with an updated revision date. Continued use of our services constitutes acceptance of revised Terms.
18.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
18.4 No Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
18.5 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to a third party upon written notice to you.
19. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales.
